PROBLEM TO BE SOLVED: To provide the radio receiving apparatus and the radio receiving method for use in a mobile communication system using CDMA (Code Division Multiple Access) method, that can suppress increase in power consumption of the radio receiving apparatus, increase in communication traffic and decline of transmission efficiency. SOLUTION: A data quality evaluation unit 102 evaluates whether any errors exist or not in a data block received for each service used. Furthermore, a request frequency setting unit 108 sets a degree of a request for retransmission of the data block received for each service used when each service is used. Also, based on the degree of a request set by the request frequency setting unit 108, it is determined whether a retransmission of a data block is required or not, which is evaluated as including errors by the data quality evaluation unit 102.
