An image processing apparatus and an image processing method in a digital broadcasting receiver are provided to scale down the size of a digital broadcasting image when caption information is included in the digital broadcasting image to prevent the caption information from colliding with EPG(Electronic Program Guide) information. An image processing apparatus(110) in a digital broadcasting receiver includes a determination unit(111) and an image processor(112). The determination unit determines whether a changed channel includes caption information. The image processor scales down a digital broadcasting image received from a digital broadcasting server, displays the digital broadcasting image on one side of a screen and displays EPG information on the other side of the screen when the channel includes the caption information.
