PROBLEM TO BE SOLVED: To provide an electrophoretic display element in which light leakage from gaps produced among charged particles is eliminated, and to provide an electrophoretic display device. SOLUTION: By using at least two kinds of charged particles A, B with nearly identical color tones and with particle diameters and mobilities mutually different as a plurality of charged particles arranged in a space between a substrate 3a and a substrate 3b, which are disposed in a state of being separated with a prescribed distance, and further by making the mobility of the charged particles B with smaller particle diameters less than that of the charged particles A with larger particle diameters, the gaps produced among the charged particles with the larger particle diameters are efficiently shielded with the charged particles B with the smaller particle diameters.
