<p><P>PROBLEM TO BE SOLVED: To provide a moving body extracting device which is suitably applicable to a moving picture which is encoded by using prediction encoding with a division block. <P>SOLUTION: An encoding mode extractor 30 connects switching means 45, 55 to a second moving body estimating unit 50 when an extracted encoding mode is an inter-frame prediction encoding system, and connects them to a position shown in the figure when the encoding mode is an in-frame prediction encoding system. A first moving body estimating unit 40 estimates whether the block is the one included in a moving body area or not based on the prediction encoding mode and a division block size. The second moving body estimating unit 50 estimates whether the moving body area or not based on a movement vector concerning each division block among the blocks of the inter-frame prediction encoding mode which are estimated as the block included in the moving body area by the first moving body estimating means.
