PROBLEM TO BE SOLVED: To provide a relaying apparatus and an optimum communication path selecting method for selecting an optimum communication path in response to a communication state for making communication in a network wherein a plurality of alternative communication paths exist in parallel. SOLUTION: The relaying apparatus is a router 11 capable of connecting terminals under its control to a WAN via a plurality of alternative communication paths and includes: a path confirmation performance means 116a for starting communication path determining processing upon the receipt of a communication start request and transmitting a communication state confirmation request through each of the communication paths to receive acknowledgement packets from the terminals; and an optimum path determining means 117a for discriminating a communication path providing a minimum throughput value or a minimum delay time of the acknowledgement packet as the optimum communication path and is principally characterized by performing communication of one session with the terminals by using the communication path selected as the optimum communication path.
