PROBLEM TO BE SOLVED: To provide a magnetic detecting element capable of firmly fixing magnetization in a fixed magnetic layer with a structure that a CIP type magnetic detecting element cannot achieve especially by the uniaxial anisotropy of the fixed magnetic layer itself for a CPP type magnetic detecting element. SOLUTION: The upper and lower portions of the fixed magnetic layer 23 are sandwiched by non-magnetic metal magnetostriction enhancement layers 22, 40. In the case of the structure of the CPP type magnetic detecting element, the upper and lower surfaces of the fixed magnetic layer 23 are sandwiched between a non-magnetic first metal magnetostriction enhancement layer 22 and a second magnetostriction enhancement layer 40 without deteriorating GMR effect, thus increasing the magnetostriction constant of the fixed magnetic layer 23 from the vertical direction, and appropriately showing magnetic elasticity effect for enabling the fixed magnetic layer 23 to be firmly magnetized and fixed.
