<p><P>PROBLEM TO BE SOLVED: To provide a data communication system and a data communication method capable of inhibiting the reproduction of contents from a transfer source when transferring the contents already recorded in a recording medium to a recording medium in another apparatus. <P>SOLUTION: When authentication operation is performed between a data communication apparatus 1 and a data communication apparatus 2 in transferring digital contents from the data communication apparatus 1 to the data communication apparatus 2, an encryption key for encrypting the digital contents is transmitted to the data communication apparatus 2 at first.
