PROBLEM TO BE SOLVED: To provide a lottery method, a lottery device and a lottery program for performing a lottery while using a situation surrounding a user as a lottery condition. SOLUTION: A user terminal 1i (i = a, b, ..., n) used by a user, a lottery performing person selection server 2 for determining a winner among users who have purchased lottery tickets, various information sites 3 existing on the Internet to provide context information to be later described, a mobile communication network 4 and the Internet network 5 for making the user terminal 1i and the lottery performing person selection server 2 mutually communicable and a position transmitting device 6j (j = a, b, ..., n) for transmitting the physical position information of the user himself/herself are included. The lottery performing person selection server 2 acquires information (context information) about situations around the user (place, weather, time period, accompanying person and behavior history) from the user terminal 1i, the various information sites 3 and the position transmitting device 6j via the communication networks and appropriately determines a winner with the context information as a lottery condition.
