PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor having excellent electric characteristics and image characteristics even when a hole transport agent having broad average molecular weight is used and to provide an image forming apparatus provided with the electrophotographic photoreceptor. SOLUTION: The electrophotographic photoreceptor is provided with a substrate, an intermediate layer and a photoreceptor layer and the image forming apparatus is provided with the electrophotographic photoreceptor. The intermediate layer contains a phenolic resin, a film forming resin having hydroxyl groups and the hole transport agent and when an added quantity of the phenolic resin and an added quantity of the film forming resin having the hydroxyl groups are defined as A1 and A2, respectively, the content (A1/(A1+A2)×100) of the phenolic resin is specified to be in the range of 10 to 80wt.%.
