PROBLEM TO BE SOLVED: To make the selection of a system easy when a blank recording medium is loaded in a data recording and reproducing apparatus which can record and reproduce data on a recording medium by using both systems of a recording system for recording audio data and a recording system where data are accessible in a file unit. SOLUTION: In the data recording and reproducing apparatus 1, it is set which recording system of a recording system (conventional MD system) for recording audio data or a recording system (next generation MD system) where data are accessible in a file unit deals with a blank disk when the disk is loaded.
