PURPOSE: An apparatus and a method for determining a motion type are provided to improve performance of motion estimation and compensation by performing motion compensation and filtering of a motion vector adaptively according to a determined motion type, thereby reducing an image deterioration factor such as a block artifact. CONSTITUTION: The first determination part extracts the first and second radio frequency signals from the first and second blocks and thereby sets the first threshold value. Thereafter, the first determination part compares the first threshold value with the first motion estimation error value between the first and second blocks in order to determine motion of the current block. The second determination part extracts the third and fourth radio frequency signals from the third and fourth blocks and thereby sets the second threshold value. Thereafter, the second determination part compares the second threshold value with the second motion estimation error value between the third and fourth blocks in order to determine the motion thereof. A motion type determination part(230) compares the results from the first and second determination parts with each other and thereby determines a motion type of the current block.
