PROBLEM TO BE SOLVED: To provide a charging device which stably holds a gap in a non-contact system even when the grain diameter of toner is small for the long term and realizes stable holding of the gap at a low cost, a process cartridge having the charging device in one and an image forming apparatus having the charging device. SOLUTION: A charging member 30 has a shaft 33, a gap holding member 34 and an intermediate resistive layer member 35. The shaft 33 is formed in the shape of a hollow cylinder and annular grooves 33a are formed on both ends of it. The gap holding member 34 is formed from a shrink tube and embedded in the annular grooves 33a without using adhesives. The intermediate resistive layer member 35 is also formed from the shrink tube, a supporting part 30B is brought into contact with the surface of a photo conductor and a spark gap is formed.
