PROBLEM TO BE SOLVED: To provide an optical disk device which can output the data of a part of a normal session to the outside system even when trouble exists in one of the sessions of the optical disk of multi-session, and a recognizing method of an optical disk. SOLUTION: In this optical disk device 1, a control means 9 obtains successively TOC information of each session of the optical disk of the multi-session, discriminates whether a command received through an interface part 10 is a read command or not, when it is the read command, it is discriminated whether a read error is caused during read processing or not, the session number in which the read error is caused is specified, when it is discriminated that the read error is caused, all sessions after this specified session number are invalidated, when a valid session exists, data of the session can be transferred to the outside system through the interface 10.
