PROBLEM TO BE SOLVED: To provide a fire resistant member capable of providing a joint part with fireproofness and fire resistance and easily constructed, and to provide its construction method. SOLUTION: This fire resistant member 10 is provided with a base material layer 11, and a thermally expansive fire-resistant material layer 12 and a cushioning material layer 13 laminated on the base material layer. The thermally expansive fire-resistant material layer 12 is formed of a material expanded by heating to form a fire-resistant heat insulating layer. The base material layer 11 is preferably formed of a metal sheet or an inorganic fiber nonwoven fabric and preferably formed with an adhesive layer 14 laminated on the surface or a part of the surface.
