PURPOSE: An apparatus for improving the call quality of a data communication of a terminal, and a method thereof are provided to reduce error probability by controlling a gap between magnitudes in basic positions of data, thereby improving the receive sensitivity of a receiver, and realizing stable high-speed data demodulation. CONSTITUTION: A data rate judging unit(412) is installed to judge a rate of data transmitted to a base band modem(411) generalizing the operation of a receiving device. A controller(413) controls a demodulator(408) and the base band modem(411) according to the data transfer rate judged by the data rate judging unit(412) by information transmitted from a central processing unit of the base band modem(411). The base band modem(411) decides a demodulation method by judging the data rate. Information of the decided demodulation method is transmitted to the controller(413). The controller(413) decides a magnitude offset between data positions by controlling the base band modem(411) and the demodulator(408) by using the information received from the data rate judging unit(412).
