<P>PROBLEM TO BE SOLVED: To enhance the transmission efficiency while reducing the transmission delay time by utilizing unused time band effectively and enhancing the error rate characteristics thereby decreasing the number of times of retransmission. <P>SOLUTION: A control section 101 makes a decision whether an unused time band is present or not in each frame from the volume of data of a transmission signal, selects such a spreading factor 32 as the unused time band disappears for the transmission signal of a frame having an unused time band, and delivers information indicative of a selected spreading factor 32 to a selecting section 103. A spreading section 102a spreads the transmission signal with a spreading factor 16. A spreading section 102b spreads the transmission signal with a spreading factor 32.
