PROBLEM TO BE SOLVED: To provide a fixing device and an image forming apparatus by which the gloss of an image is controlled without complicating the device structure and also without deteriorating the productivity. SOLUTION: The fixing means 10 is constituted of at least a fixing means 10 which consists of a heating rotary body 2 and a pressing rotary body 6 rotating while forming a fixing nip part by coming into press-contact with each other and by which a toner image 26' is obtained by fixing an unfixed toner image 26 by inserting a recording material 24 where the unfixed toner image 26 is formed through the fixing nip part and an ejection means 30 including a pair of ejection rotary bodies 32a and 34 to assist ejection to the outside of a system by feeding the recording material 24 passing through the fixing nip part while holding it. In the ejection rotary body abutting on the surface of the side of the toner image 26' of the material 24 in the ejection means 30, a plurality of the ejection rotary bodies 32a, 32b and 40 having mutually different surface states are made switchable, and the image forming apparatus using it is provided.
