<P>PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor in which neither light scattering nor a bleeding occurs, which has a photoreceptor layer of a uniform state, and in which low surface energy is compatible with mechanical and electric durability, and to provide a high resolution electrophotographic photoreceptor which has a surface protection layer of an optically uniform state and in which surface hydrophobicity and mechanical performance, such as hardness and strength, are compatible with electric durability, such as arc-discharge resistance. <P>SOLUTION: The electrophotographic photoreceptor has a surface layer containing a polycondensation product of the organic silicon modified positive hole transfer compound of a formula (1) and a polycondensation product of a silane coupling agent which has a fluoroalkyl group of a formula (2). The surface protection layer contains a silicone oil and a siloxane resin, and the siloxane resin condensed has a structure of RSiO<SB>3/2</SB>.
