PROBLEM TO BE SOLVED: To shorten a communication time by exactly setting a data transmission rate by further reflecting a quality level of a communication line lowered by an echo. SOLUTION: A data transmission rate decided in a phase 4 is limited by a limiting transmission rate by not only selecting and setting a symbol transmission rate in a phase 2 of an advice V.8 communication procedure but also selecting the limiting transmission rate of data corresponding to the S/N of a telephone line 2. Thus, in the case of measuring the S/N of the line 2, the echo of each signal or other signal is superposed on probing signals L1, L2 used for this measurement. If the S/N of the telephone line 2 is lowered, the limiting transmission rate corresponding to this S/N is also lowered, and the data transmission rate is suppressed to a low value.
