PURPOSE: A device and a method for maintaining horizontality of a driver's seat, using a driver's seat gradient sensor are provided to conveniently travel by correcting the gradient of the driver's seat during traveling. CONSTITUTION: A device for maintaining horizontality of a driver's seat, using a driver's seat gradient sensor comprises a driver's seat turning right and left around the center of a rotating shaft(16); a target wheel(10) with teeth(13) having each different spacing and period around the central axis of the driver's seat; a sensor(11) supported to the center of the rotating shaft, to always maintain a vertical state regardless of the gradient of the driver's seat; a support(12); and an ECU(Electronic Control Unit,14). The target wheel is integrally formed to the rotating shaft and the target wheel rotates circularly together with the driver's seat. The sensor detects a high signal interval and period from the arrangement structure of the teeth of the target wheel. The ECU analyzes and decides the high signal interval and period input from the sensor and then outputs a control signal for an actuator(15), to maintain the horizontal state of the driver's seat.
