PROBLEM TO BE SOLVED: To provide a recording medium whereby an original or a copy can be discriminated without the need for intentional defect insertion so as to contribute to copy prevention. SOLUTION: An EFM (eight to fourteen modulation) modulator 12 receives particular data having a particular data pattern such as FAFAh from a terminal 8. The EFM modulator 12 selects connection bits capable of converging a DSV (Digital Sum Variation) in a state of relaxing the run lengths lit of Tmin=3 and Tmax=11 from the particular data after the EFM. A master disk 4 is produced on the basis of an output of the EFM modulator 12. The connection bit of only '000' can be selected tom the particular data FAFAh under the run length limit, the DSV is divergent and the reproduction is damaged at reproduction. Thus, the CD produced in this way cannot be reproduced, resulting in prevention of copy of contents can be prevented. Since the FAFAh data is a low level signal as audio, no effect is given to the reproduction by an ordinary CD reproducing apparatus. COPYRIGHT: (C)2004,JPO
