PROBLEM TO BE SOLVED: To provide a radio communication device which discriminates the occurrence of resending in the second layer (data link layer), and switches to a communication channel. SOLUTION: The radio communication device is connected to set a communication channel between a radio communication network, and sends and receives data with the radio communication network. The device provides a channel switching means which switches the communication channel set between the radio communication network, based on a discrimination result of a discrimination means which discriminates an occurring state of resending in the data link layer.
