PROBLEM TO BE SOLVED: To provide an optical path splitting element capable of easily changing the positions of separated images and a microscope having the same. SOLUTION: The optical path splitting element 32 is arranged with a plurality of optical members DM1 and DM2, at least one thereof being a dichroic mirror, in superposition at a desired angleδand splits the incident light L on the optical members DM1 and DM2 to optical paths L1 and L2 varying with each of different wavelengths 1 and 2, in which the desired angleδof the optical members DM1 and DM2 is made variable.
