<p><P>PROBLEM TO BE SOLVED: To provide an electrostatic image developing toner which can be used as either a colored or achromatic toner, containing a charge control agent having good affinity and dispersibility in a resin and having rapid charging, environmental protection and excellent storage stability, and to provide charge control resin particles used for the toner. <P>SOLUTION: The charge control resin particles are prepared by incorporating a resin and a charge control agent represented by formula 1, containing crystalline 3,5-di-tert-butyl zinc salicyate giving major peaks of Bragg diffraction angle 2θat least at 6.4±0.2°and 15.4±0.2°by X ray diffraction analysis using the characteristic CuKαline.
