PURPOSE: A wireless communication device and a wireless communication method therefor are provided to convert a type of a data packet into a dynamically suitable packet type according to a packet error rate of the data packet and transmit the converted data packet. CONSTITUTION: A transmitting and receiving unit(21) transmits and receives a data packet with an external device. A packet type selecting unit(29) selects a type of the data packet. An arithmetic unit(25) calculates a packet error rate and a transmission time about the data packet. A control unit(27) controls the packet type selecting unit(29) on the basis of the packet error rate and the transmission time so that a packet type is selected to be capable of transmitting a subsequent data packet in an optimum efficiency and minimum time. The control unit(27) controls the transmitting and receiving unit(21) so that the subsequent data packet is transmitted as the selected packet type.
