PROBLEM TO BE SOLVED: To provide a rail fastening device and a rail fastening method capable of position adjustment in right and left direction of a rail at a bridge tie or the like. SOLUTION: This device comprises a tie plate 1, a base pad 2, screws 3, stud bolts 5, and a lateral pressure receiving member 6 having a diagonal side 6b1 and a long hole 6a1, etc., to properly adjust a position in a length direction of the bridge tie T corresponding to a position of the tie plate 1 for transmitting lateral pressure transmitted from the rail R through the time plate 1 to the stud bolts 5 to be supported.
