SOLUTION: One or more maximum bit rate measuring means which measures a maximum bit rate for every prescribed time interval of an inputting transport stream and a recording-and-reproducing means which records the transport stream at a time of recording, records or holds the maximum bit rate information measured by a maximum bit rate measuring instrument together with the transport stream when the recording is finished, reproduces and outputs the recorded transport stream at a time of reproduction and outputs an optimum recording mode information introduced based on the corresponding maximum bit rate information are provided.
