PROBLEM TO BE SOLVED: To obtained a cis-control factor derived from a higher plant, responding to a DNA damage to bring about transcription activation. SOLUTION: This DNA damage response promoter contains (a) a DNA containing a specific base sequence derived from Arabidopsis thaliana, (b) a DNA comprising a base sequence in which in the base sequence, one or several bases are deleted, substituted or added and exhibiting DNA damage response or (c) a DNA which is hybridized with a DNA composed of the base sequence under a stringent condition and exhibits DNA damage response.
