PROBLEM TO BE SOLVED: To provide a data transmitter that monitors a delay in cells in a cell buffer for a transmission queue in the case of assembling user data into cells and transmitting the cells to a transmission channel and aborts a cell when the delay in the cell exceeds a permissible delay and causes no deterioration in the quality of the user data through a type of a channel where a user data rate is high and a TTI(Transmission Time Interval) is set longer and to provide a data transmission method. SOLUTION: A shaping execution decision section 301 references a channel type for a cell at a pre-stage of a transmission channel interface section 206 to decide execution/non-execution of shaping and writes the cell to a cell buffer 302 when deciding the execution of shaping. A read control section 303 reads the cells from the cell buffer 302 at a read interval at which the cells are not aborted by the transmission channel interface section 206 due to excess of the permissible delay in the buffer and outputs the read cells to the transmission channel interface section 206.
