APPARATUS AND METHOD FOR DETERMINING TRANSMISSION RATE OF PACKET DATA OF MOBILE COMMUNICATION SYSTEM

PURPOSE: An apparatus and method for determining the transmission rate of packet data of a mobile communication system is provided to simultaneously perform a voice conversation and the transmission of forward packet data with a maximum transmission rate by determining the data rate for a packet data service with reference to the number of usable orthogonal(Walsh) code as well as a CIR(Carrier to Interference Ratio). CONSTITUTION: A mobile station receiver(1101) receives orthogonal code assignment information for indicating the number of orthogonal code assigned for a packet data service. A pilot sub-channel demodulator and CIR measurer(1104) measures a CIR through a receipt pilot channel. A mobile station data rate controller(1105) determines a data rate corresponding to the measured CIR, adjusts the determined data rate on the basis of the number of assigned orthogonal code, and determines the adjusted data rate.
