PROBLEM TO BE SOLVED: To provide an apparatus and a method for a data communication, wherein the transmission delay of information responding to received information from a base station can be eliminated in a mobile station, and the radius of the communication zone of the base station can be expanded. SOLUTION: When the base station performs a scheduling operation to allocate a band according to a down/up communication traffic volume, a slot 204 for other mobile stations is allocated between a down slot 202 and an up slot 203 for the same mobile station within the same frame.
