PROBLEM TO BE SOLVED: To provide an optical modulating element which has high luminosity and high contrast ratio, specially, the optical modulating element which is suitable for reflection-type and projection-type displays. SOLUTION: This element is equipped with a couple of substrates 10, at least one of which is transparent, and a porous structure which is sandwiched between both the substrates and changes the shape of pores 12 in the porous structure with an external stimulation input to modulate incident light 15. For example, when a piezoelectric element as a stimulation responsive element to the optical modulator, pores 12 can be put in an intense light scattering state by adjusting the size of the pores almost to the wavelength of light, when no voltage is applied and in a light-transmitting state, by decreasing or eliminating the size of the pores when a voltage is applied.
