PROBLEM TO BE SOLVED: To provide an information recording and reproducing device which can perform processing of a data analysis recording system and a data non- analysis recording system distinguishing clearly the both. SOLUTION: When an information recording mode is a data analysis recording system (Cognizant Mode) analyzing buried copy control information(CCI), a key for a data analysis recording system (Cognizant Mode) as a key for generating contents ciphering key in a data analysis recording system (Cognizant Key) is applied, when an information recording mode is a data non-analysis recording system (Non-Cognizant Mode) which does not analyze buried copy control information(CCI), a key for a data non-analysis recording system (Non- Cognizant Mode) is applied, a contents ciphering key is generated, and ciphering processing of contents is performed. Two data recording systems are performed being distinguished clearly by this constitution, the occurrence of mismatching of EMI being copy control information and buried CCI (Embedded CCI) is prevented.
