PURPOSE: A modem and a method for controlling a data transmission rate thereof are provided to send maximum data to a line within a range not causing data overflow. CONSTITUTION: According to a modem(ATU-R; ADSL Terminal Unit Central Office Receiving Unit)(12) installed in a subscriber part, a CPU(32) is connected with an ethernet interface(42) through an SCC2 bus, and is connected with an ADSL interface(44) through an UTOPIA bus, and performs a SAR(Segmentation and Reassembly) function. Also, the ATU-R has a transmission rate determining part(34) determining a data transmission rate of the modem. The transmission rate determining part includes an APC timer, an APC timer control part, a TCT, a transmission queue and a transmission part.
