PURPOSE: An adaptive quantization apparatus and a method thereof considering image activity are provided to reproduce the optimum picture quality by remarkably reducing quantization distortion by a block having low activity. CONSTITUTION: A class decision element decides the class of discrete cosine transformed blocks according to the activity. A temporary storing element temporarily stores the discrete cosine transformed blocks by the segment. A data amount estimating element decides the level of macroblocks according to the number of the class of the discrete cosine transformed blocks, decides quantization according to the level, and quantizes and codes accordingly for controlling and outputting quantization number to approximate the generated data amount to arbitrary reference value. The first quantization element quantizes the discrete cosine transformed blocks by the segment stored in the temporary storing element by using the quantization number outputted from the data amount estimating element.
