PROBLEM TO BE SOLVED: To provide a device for controlling traffic while considering the frame of a higher-order layer than a layer specifying a fixed length packet on a fixed length packet network. SOLUTION: A UPC processing part 31 discriminates whether or not an arriving cell violates a declaration parameter. When a cell transmitted by a GFR service is received, while considering an AAL 5 frame, a frame processing part 33 changes the discriminated result of the UPC processing part 31. A cell processing part 35 abandons the arriving cell according to the discriminated result of the UPC processing part 31 (the changed result when the discriminated result is changed by the frame processing part 33).
