SOLUTION: An encoder buffer 73 which temporarily accumulates the encoded signal of an encoder system-side in encoding a digital signal at a variable bit rate has a code buffer 731 used for rate control by an encoder system. The output bit rate Rout from the encoder buffer 73 is changed to the value Rcur of the new encoding bit rate after prescribed delay time τ from the time when the encoding bit rate Rcur is changed by setting the size of the code buffer 731 to be constant.
