An apparatus for selecting whether a received data segment is valid or not, and a method thereof are provided to determine whether the contents of the data segment is valid or not in response to the measurement of a BER(Bit Error Rate) of a header portion of the data segment. An apparatus for selecting whether a received data segment is valid or not includes a payload portion error measurer(38), a header portion error measurer(42), and a data segment acceptor(48). The payload portion error measurer checks a CRC(Cyclic Redundancy Code) in the payload portion of the data segment. If the CRC of the payload portion passes the CRC check, the payload portion error measurer provides a signal which indicates that the payload portion passes the CRC check. The header portion error measurer is coupled to the payload portion, and is configured to analyze a header portion of the data segment in response the signal. The header portion error measurer measures a bit error rate of the header portion. The data segment acceptor accepts selectively the data segment valid in response to the bit error rate of the header portion which is measured by the header portion error measurer and the CRC check passing.
