The present invention relates to an apparatus for switching the driving mode of a vehicle, capable of safely switching the automatic driving mode of a vehicle into the manual driving mode, and a method thereof. According to an embodiment of the present invention, the apparatus for switching the driving mode of a vehicle comprises: a detection part, a mode switching intention detection part, a driving availability detection part, a driving state deduction part, and a control part. The detection part detects the state of the driver of a vehicle, which allows automatic driving and manual driving. The mode switching tension detection part detects user′s mode switching intention of switching the driving mode of the vehicle into the manual driving mode based on the driver′s state detected when the vehicle is in the automatic driving mode. The driving availability detection part detects whether the driver can drive the vehicle in the manual driving mode based on the user′s state detected after detecting the mode switching intention. The driving state deduction part deducts a driving state of the vehicle by an input operation of the driver when the driving mode of the vehicle is assumed to be the manual driving mode during a preset time, based on a result of the detection that the driver can drive vehicle in the manual driving mode. The control part switches the driving mode of the vehicle into the manual driving mode based on the deducted driving state of the vehicle satisfying a preset condition. |
