An apparatus of a mobile communications system operated in a licensed band comprises the following steps: verifying an occupying status of a channel in an unlicensed band; waiting a set random backoff period when the channel is in an idle status; transmitting a preamble to notify occupation of the channel when the channel is occupied after the random backoff period; and then, transmitting data.
