<p><P>PROBLEM TO BE SOLVED: To provide communication device, communication method and communication program, capable of appropriate channel assignment. <P>SOLUTION: The communication device includes: detection unit for detecting a command from a reception signal of a channel; determination unit for determining from the command a communication scheme being in use; and a communication unit for, based on the channel and the communication scheme, communicating through a communicable channel. In the communication method, a command is detected from a reception signal of a channel, and a communication scheme being in use is determined from the command, and based on the channel and the communication scheme, communication is performed through a communicable channel.
