The present invention relates to diagnosing a malicious code based on cloud. An apparatus, a system and a method for diagnosing a malicious code based on cloud enables the diagnosis of a malicious code for an application based on cloud and can prevent a waste of resources and deterioration of network speed, which may occur in a process of uploading an application file by uploading only a part of specified files required for diagnosis of a malicious code in the entire file of the application without uploading the entire file of the application for sampling of a cloud server when a new application is detected on a mobile terminal, wherein the diagnosis of a malicious code is not performed for the new application.
