A filter device disposed on a moist fluid passage of a system including moisture in the fluid, the filter device comprising: a fluid introducing path in which fluid that flows on the moist fluid passage is introduced into a filter room from below filter room, a filter member in which the fluid introduced from the fluid introducing path into a filter room is permeated and the foreign matter in the fluid is removed, a filter placed in the filter room,a water pooling portion, which is provided on the lower position than the filter member on sidewall side of the filter room bottom on the periphery of the filter, or a water pooling portion, which is provided on the lower position than the filter member of the filter, or a water pooling portion, which is on both positions, a fluid discharge path in which the fluid that passed the filter is discharged, wherein, as the water level of the water pooling portion becomes a water level which is arrived to the filter member of the filter, a gap size J1 between the filter and the sidewall of the filter room is designed to become a predetermined size.
