<P>PROBLEM TO BE SOLVED: To provide a phosphor that emits yellow color to orange color or orange color to red color when excited with a near-ultraviolet region to a blue-color region light and has high brightness and luminous efficiency. <P>SOLUTION: The phosphor comprises as a base a nitride or an oxynitride which has, in a powder X-lay diffraction pattern measured by using CuKα ray (1.54184 Å), the strongest peak in the range where 2θ is 34-36.7° and the peak strength ratio I of 4% or less, of the peaks existing in the range where 2θ is 10-17°. Wherein, the peak strength ratio I is a ratio of the height of the peak I<SB POS="POST">p</SB>to the height of the strongest peak I<SB POS="POST">max</SB>existing in the range where 2θ is 34-36.7°, (I<SB POS="POST">p</SB>×100)/I<SB POS="POST">max</SB>(%), in the powder X-ray diffraction pattern in the range where 2θ is 10-60°.
