PURPOSE: A state determining device for deciding the state of a battery, an electricity storage device and a method thereof are provided to clarify the changes of determination value by the acquisition of the determination value from the first charging time and the second charging time, and to judge the state of the electricity storage device by using evaluation value with high precision. CONSTITUTION: A state determining device includes a BMS(20) which comprises a control unit(30), a current meter(22), and a voltage meter(24). The current detector detects the charging current of an electricity accumulating element. The control unit acquiring the first and second charging time produces the determination value by the use of the first and the second charging time.
