PURPOSE: A pre-negotiation apparatus of a mobile station and method thereof are provided to reduce the generation of a control message and necessary time of a negotiation of a mobile station. CONSTITUTION: A mobile station performs an initial connection process of a first communication mode. The mobile station receives information whether the base station is a mixing mode base station which supports the first communication mode and a second communication mode from the base station(300). In case the base station indicates the mixing mode base station, the mobile station completes the initial connection process. The mobile station transmits and receives a pre-negotiation message with the base station(314).
