PURPOSE: An in-loop filtering apparatus of an image data, a method thereof, and an encoding/decoding apparatus using the apparatus and the method are provided to improve the encoding efficiency through an accurate estimation in motion estimation and compensation apparatuses when encoding an image. CONSTITUTION: An in-loop filter apparatus comprises an in-loop filter generator(151), an in-loop filter applying unit(152), and a loop filter information generator(153). The in-loop filter generator generates first and second in-loop filters. Through the first and second in-loop filters, the in-loop filter applying unit performs a selective filtering operation for the block border or block inner part of an image. The loop filter information generator generates the in-loop filter information.
