PROBLEM TO BE SOLVED: To suppress a code amount so as to be less than a desired value more surely.

SOLUTION: A rate control unit 118 predicts a generating code amount which is generated when an image is encoded. A code amount control unit 142 controls so that an intra prediction mode of the same prediction direction is applied for respective blocks encoded employing intra prediction in an image when predicted generating code amount exceeds a predetermined value. An intra prediction unit 125 encodes respective blocks by the applied intra prediction mode. This invention can be applied for the encoding device.
