PROBLEM TO BE SOLVED: To provide an electrophotographic photoreceptor which has a high-hardness and uniform surface layer, has scratch resistance to photoreceptor surface, has low abrasion, does not cause image blur or the like and has endurance for long term use, and to provide an image forming apparatus using the electrophotographic photoreceptor. SOLUTION: The electrophotographic photoreceptor is made by laminating a photosensitive layer and a surface layer onto an electroconductive support in the order, wherein the surface layer is formed by subjecting a composition containing metal oxide particles of which the surfaces are treated with a compound having at least methacroyl group to curing reaction, and a peak value (Tac) of 1,610 to 1,640 cm<SP>-1</SP>and a peak value (Tcb) of 1,700 to 1,800 cm<SP>-1</SP>in infrared absorption spectrum of the surface layer after curing satisfy the range of the following formula (1): 1.0≤(Tac/Tcb)×100≤20.
