<P>PROBLEM TO BE SOLVED: To provide an evaporator and a refrigerating machine capable of properly securing the gas-liquid separation performance of a demister 18. Ž<P>SOLUTION: The evaporator 12 includes a heat transfer tube 15 as a flow channel of a hot matter, and the demister 18 separating the passing refrigerant into gas and liquid, and the refrigerant evaporated and vaporized by heat exchange in the heat transfer tube 15 is separated into gas and liquid by the demister 18 and discharged to the external from a refrigerant gas discharge port 21. Here, an area where the refrigerant can pass of an installation area of the demister 18 is called an opening of the demister 18. A closing section 26 is disposed near the refrigerant gas discharge port 21 to close the opening of the demister 18, and the opening of the demister 18 is divided into a plurality of areas having different opening areas at the closing section 26 as a boundary.
